May 22 Texas HB 1046 regarding animal seizures gets new life! May 22, 2009 New life has been given to Rep. Mark Homer's HB 1046 which allows animal owners an appeals process regarding animals seized for animal cruelty. Senate Bill 408 has been amended to include Homer's House Bill 1046. But he needs our help in support of this bill. Two actions are required: 1. Please FAX letters of SUPPORT for HB 1046 to Rep. Mark Homer from organizations or individuals. FAXES ONLY! CALL: (512) 463-0116 FAX: (512) 463-3135 TALKING POINTS: (Copy and paste your choices.) -- A person's animals can be taken away from the owner based on a single hearing heard by a single judge without a trial. -- The hearings occur within ten (10) days of the seizure but can happen within a day or two putting the owner at a disadvantage by not giving him time to prepare or find an attorney. -- Owners often appear without representation and have no idea that their animals can be permanently taken from them at this single hearing. -- A chance for an appeal sets up a system of checks and balances that is integral to our system of justice. -- Local humane organizations trying to get the animals often testify in these hearings and they are usually respected, so it adds even more difficulty for the animal owner. -- Since the owner has to post an appeal bond for expenses of caring for the animals as a condition of an appeal, there will not be extra costs to the facility housing the animals as has been alleged by the opposition to this bill. -- Most cases of any kind are never appealed so there is not going to be a huge number of these cases clogging the courts. -- Texas Humane Legislation Network (THLN) and PETA falsely claim that city or county attorneys would have to try these cases twice and that the owner would get an entirely new trial. The truth is that the owner does not currently get a trial, only a hearing. -- THLN and PETA indicate that seizures often involved hundreds of animals and that they are almost always malnourished so they will suffer longer. The truth is that if an animal is suffering state law provides for their humane euthanasia and if any animals are malnourished they will be fed. Further, most seizures do not involve hundreds of animals. The media tends to report large seizures, but the majority of them involve a small number of animals. -- This bill is opposed by animal rights groups including Texas Humane Legislative Network (THLN), a lobbying corporation, and People for the Ethical Treatment of Animals (PETA), a multi-million dollar 501(c)(3) corporation headquartered in Virginia. These groups have put out email Action Alerts that falsely claim that the expenses of an appeal would prevent animals from smaller cities and counties being able to pursue these cases. The truth is that the owner has to post an appeal bond to cover expenses for care of animals as prerequisite to an appeal. -- The animal owner often faces testimony against him from animal control, the peace officers involved in the seizure, the county or city attorney, representatives from humane organizations seeking to get the animals, veterinarians, and any other witnesses offered against him. The owner is at a distinct disadvantage in these hearings. -- The owner's animals are seized before he ever has a chance to defend himself. It is much harder to get back something than it is to keep something, so these hearings are very hard for the owner to win. May 21 Texas HB 2310, Breeder Bill, is on the move! May 21, 2009 Action Alert! Bear with us, only one more week! Re: HB 2310, Relating to the powers and duties of the Texas Department of Licensing and Regulation, including the power to issue emergency orders and temporary and emergency licenses, has been sent to a Conference Committee. This is the bill that was hijacked by Senator John Whitmire and amended to include the misnamed "Puppymill Bill." Rep. Edmund Kuempel, the bill author, did not accept the amendment; therefore the Conference Committee was formed. Contact all Conference Committee members below with this suggested wording: "We ask that you remove Floor Amendment #1 from HB 2310. There was no public hearing held and Rep. Edmund Kuempel objected to his bill being amended. Actions such as this cause us to lose all faith in our elected officials who don't appear to be representing us. You have been lied to about this bill regulating "puppymills." It is a radical national "animal rights" agenda to end all dog and cat breeding in the U.S. HSUS will be back each legislative session to tighten the noose until they achieve their agenda." May 20 Texas Veterinary Medical Association Opposes HB 3180May 20, 2009 Texas Veterinary Medical Association (TVMA) has announced their OPPOSITION to HB 3180, the misnamed "Puppymill Bill" and is feeling the wrath of Texas Humane Legislation Network (THLN)! THLN accuses TVMA of taking an "irresponsible position" and being callous; asking if they "support cruelty?" Sounds like what they say about Responsible Pet Owners Alliance! We're in good company. Texas Humane Legislation Network sent out an alert today asking members to contact their veterinarians and get them to support HB 3180 by calling the Senate Criminal Justice Committee members below. Although it was pulled from yesterday's agenda due to the lack of votes required for passage, HB 3180 is not dead and can be rescheduled at any time with 24 hours notice. We're still in full alert until May 28th, the day after the deadline for all Senate bills to have a Floor vote. You're to be congratulated for your hard work which has paid off so far. But we must remain vigilant and not let up now! Anything can happen. We hear Senator Whitmire may try to amend the bill and try again. So everyone should call, fax and email the committee members below and tell them: "HB 3180 is fundamentally flawed and cannot be fixed with amendments as it is a radical national animal rights legislative agenda." That's all you need to say. Call your veterinarians today and ask that they contact the Criminal Justice Committee members below to OPPOSE HB 3180, the misnamed "Puppymill Bill." Thank TVMA for their position. Or you can forward or fax your vets this message! TVMA has taken an educated stand on behalf of responsible pet owners in this state. Let your veterinarian hear loud and clear that you support TVMA's stand and have your vets call and demand that Senators oppose this duplicative, wasteful and unenforceable proposal. This bill as written would cause veterinarians to be mired in legal disputes between buyers and sellers on issues of inherited diseases and other matters that take away vets' valuable time from healing our pets. If Texas Humane Legislation Network wants to help dogs and cats in cruel situations, they need to stop wasting hundreds of thousands of dollars on their salaries, lobbyists and politics, and spend those funds supporting the arrest and prosecution of abusers under existing animal cruelty laws.
